Daily Food Plan Terms of Service
Last updated: October 11, 2026
These terms are an agreement between you and Daily Food Plan, a sole proprietorship ("Daily Food Plan," "we," "us"), 28 Geary Street, Suite 650 PMB 5482, San Francisco, CA 94108. By using Daily Food Plan at dailyfoodplan.com or app.dailyfoodplan.com (the "Service"), you agree to them. Please also read our Privacy Policy and our Refund and Cancellation Policy, which are part of these terms.
1. What Daily Food Plan is, and isn't
Daily Food Plan is a daily checklist for your food and supplements. You set up what you plan to eat and take, check things off as you go, and can see the numbers you choose to see.
Daily Food Plan is not medical advice. It doesn't diagnose, treat, or prevent any condition, and it doesn't tell you what or how much you should eat. It shows the facts you or your professional put on your board. Nutrition numbers come from public sources (such as the U.S. Department of Agriculture and Open Food Facts), from product labels, from web pages, or from what people type in, and they may be wrong or incomplete. Always check labels, and talk with a doctor, dietitian, or other qualified professional before changing your diet, supplements, or medications, especially if you have a health condition, are pregnant or nursing, or have a history of disordered eating.
Reminders are a convenience. Don't rely on them for medications or anything where a missed reminder could harm you.
AI features. Some features use an AI service: the setup chat, reading a food label from a photo or pasted text, and looking a food up on the web. AI can make mistakes. Check what it finds before you save it. It is a way to save typing, not a source of advice.
2. Who can use it
You must be at least 18 years old to use the Service. If you use the Service for an organization, you confirm you can agree to these terms for it. The Service is run from the United States and is available worldwide. You're responsible for following the laws where you live.
3. Your account
You can use Daily Food Plan without an account; your board then stays in your browser on your device, and clearing your browser data erases it. To save your board in an account, you sign in with a code we send you: by text message to your mobile number, or by email where email sign-in is offered. Message and data rates may apply. You're responsible for your phone, your email, and for activity under your account. Tell us right away if you think someone else has used it.
One account is for one person. Don't share a sign-in. A signed-in Free board opens on one device at a time. A Professional account can be signed in on up to three devices at once; signing in on another one signs out the device used longest ago.
4. Plans and payment
- Free is free. It includes the daily checklist and the features listed on our pricing page.
- Plus is for one person. Family covers up to 6 people; one person (the owner) pays and everyone in the family gets Plus. Coach, Advisor and Practice are the Professional plans; they include a limit on active clients (see section 8).
- The features and prices of each plan are shown on our pricing page and again at checkout, before you pay. Prices are in U.S. dollars. We don't currently charge sales tax. If we're required to, we'll show it before you pay.
- If a paid plan ends, the features it includes stop, but your information stays. For example, extra plan types and recipes stay on your board, and you can use anything Free includes.
Renewal and cancelling
Paid plans renew automatically. A monthly plan is charged every month and a yearly plan every year, to the card you gave Stripe, until you cancel. Stripe emails a receipt for each charge, and a reminder before a yearly plan renews.
You can cancel at any time, without contacting us: in the app, open the menu, then Payments, then Plans and billing, then Manage billing. You keep your paid plan until the end of the period you already paid for, and it doesn't renew. Cancelling doesn't delete anything. Payments are processed by Stripe, which also emails your receipts.
Changing plans
You can switch between plans (for example Plus to Family, or one Professional plan to another) and between monthly and yearly yourself in Manage billing. The change takes effect right away. Stripe credits you for the unused part of the plan you're leaving and charges the new plan for the rest of the period. The difference is shown before you confirm: a higher plan is charged now, and a lower plan leaves a credit that comes off your next invoice.
If a payment fails
If a renewal payment doesn't go through, Stripe tries the card again over the following days, and we show a "payment problem" note in Plans and billing so you can update your card. You keep your paid plan for 7 days after the first failed payment. If it hasn't been paid by then, your account returns to Free. Nothing is deleted; you can upgrade again at any time.
Refunds
You can ask for a refund of a charge within 30 days of it. A refund also ends the paid plan it was for, and your account returns to Free. The details are in our Refund and Cancellation Policy. If a payment is disputed with your card company, the paid plan stops while the dispute is open; please contact us first, because we can usually sort it out faster.
Price changes
We'll tell you at least 30 days before a price change affects you, and you can cancel before it does.
Deleting your account
If you delete your account while you have a paid plan, we cancel your subscription at once and the app warns you first. Deleting doesn't by itself refund the current period; see the Refund and Cancellation Policy.
5. Gifts, early access and codes
We may give some people free access: a gift plan with an end date, or early access to Plus features while we test the Service. A code is for the person it was given to, can be used once, and we may end a gift or early access at its end date, or sooner if it's misused. When it ends, your account returns to Free and nothing is deleted. A gift or early access isn't a paid plan and has no refund value. A promotion code on a paid plan (such as the early-access price we promised some early applicants) gives the price it describes for as long as it says, and we may end a code that is misused.
6. Your content
"Your content" means what you put in the Service: your lists, routine, recipes, notes, goals, photos, and what you share.
- You own your content. You give us permission to store, copy, and display it only as needed to run the Service for you and for the people you choose to share with (such as your family or people with your link).
- You're responsible for your content. Only upload photos and text you have the right to use.
- Sharing. When you share a plan or a look, anyone with the link can see what you shared until you stop sharing it. If someone adds your shared plan or look to their board, they keep their copy even after you stop sharing.
- Families. Items in a family's shared Pantry, Cabinet, and recipes can be seen and changed by everyone in that family, except items you mark Private. If the person who pays for a Family plan stops paying, the family's members return to Free.
7. Feedback
If you send us feedback or ideas, we may use them to improve the Service without owing you anything. We won't share your name or contact details when we do.
8. Professionals
If you use Daily Food Plan as a coach, dietitian, trainer, or other professional ("Professional"):
- You're responsible for the advice and plans you give your clients, and for holding any licenses and following any laws and professional rules that apply to you, including privacy and health-information laws.
- Daily Food Plan is a tool for your clients' daily plans. It is not designed to store medical records, and it is not a HIPAA business associate. Don't put diagnoses or other protected health information in plans, notes, or messages.
- Your clients' check-offs and history are private to them. You can't see them through the Service, and you agree not to try.
- You're responsible for having permission to invite your clients and for how you use their phone numbers or email addresses.
- Client limits. Coach includes up to 10 active clients, Advisor up to 20, and Practice up to 75. A client is active while they're on your roster; archiving or removing one frees the place at once. At your limit you can't add new clients until you upgrade or free a place. Your current clients keep their plans. If your plan changes and you end up over a lower limit, you have 30 days to get back under it, and no client is removed.
- Your clients are Free users. The Professional plan doesn't pay for your clients' Plus. They can use everything you assign them. If they want Plus features of their own, they sign up for Plus themselves.
- If you stop paying, your clients keep a free board with the last plan you gave them and see a short note that the plan is no longer being updated.
9. Acceptable use
Don't:
- break the law or anyone else's rights, or upload content you don't have the right to use;
- share content that is hateful, harassing, sexually explicit, or that promotes self-harm or disordered eating;
- try to get into anyone else's account or information, or get around our security or plan limits;
- overload, scrape, copy, or reverse-engineer the Service, or use it to build a competing product;
- use sharing or invites to send spam.
We may remove content or suspend accounts that break these rules.
10. Other companies' content and services
The food finder uses public nutrition data (U.S. Department of Agriculture, Open Food Facts), and the ready-made looks use photos from Unsplash. Sign-in codes are sent by Twilio (text) or our email provider, AI features are provided by Anthropic, and payments are handled by Stripe. Their content and services are provided by them, under their own terms, and we don't guarantee their accuracy or availability.
11. Changes and ending
- We may change or discontinue features. If we make a change that significantly reduces what a paid plan includes, we'll tell you in advance and you can cancel and ask for a refund of the current period.
- You can stop using the Service and delete your account any time in Settings → Account → Delete my account and data.
- We may suspend or end your access if you break these terms or if we have to for legal reasons. If we end the Service entirely, we'll give reasonable notice where we can so you can download your log, and we'll refund any period you paid for and didn't get.
12. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't promise the Service will be uninterrupted or error-free, or that nutrition information is accurate.
13. Limitation of liability
To the fullest extent the law allows, Daily Food Plan won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or health outcomes, arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or $50. Some places don't allow these limits, so they may not apply to you.
14. Indemnity
If you use the Service in a way that breaks these terms or the law and someone makes a claim against us because of it, you agree to cover our reasonable costs of that claim.
15. Disputes
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts in San Francisco County, California, unless the law where you live gives you the right to bring a claim there. Nothing in these terms takes away rights that the law where you live gives you as a consumer.
16. Changes to these terms
If we change these terms, we'll update the date at the top. If a change is significant, we'll tell you in the app or by email before it takes effect. If you keep using the Service after that, you accept the new terms.
